Quality and compliance

Results you can check. Rules we never bend.

We publish OceanCare's licensing status, which rules we follow, what we measure and how to raise a concern. Trust should not require taking our word for it.

Our licensing, in the open

  • Legal nameGracious Care Health Services, Inc., an OceanCare Health company
  • State licenseChange of ownership in process with Texas Health and Human Services. The new license number will be listed here once the state issues it.
  • MedicareMedicare certification status will be listed here once confirmed
  • AccreditationAccreditation status will be listed here once confirmed

Anyone can verify a Texas home health agency's license, ownership and service categories using the state's Long-Term Care Provider Search. Texas law does not allow an agency to provide or advertise home health services without a license (Texas HHS HCSSA program).

The rules we operate under

Home health in Texas is governed by two layers of regulation, and we treat both as the minimum standard:

  • Texas Home and Community Support Services Agency rules, 26 Texas Administrative Code Chapter 558, covering licensing, client rights, staffing, supervision, records and complaint handling (Texas HHS statutes and rules).
  • Federal Conditions of Participation for home health agencies, 42 CFR Part 484, covering patient rights, comprehensive assessments, care planning, quality improvement, infection control and aide training and supervision (eCFR).
  • HIPAA Privacy and Security Rules and the Texas Medical Records Privacy Act, Texas Health and Safety Code Chapter 181, which protect patient health information.
  • Section 1557 of the Affordable Care Act and Section 504 of the Rehabilitation Act, which prohibit discrimination and require language and disability access.

How compliance shows up in care

  • Start of care on the clock. Initial assessment within 48 hours of referral or return home, or on the physician-ordered date, and a comprehensive assessment within five days.
  • Licensed, verified clinicians. Licenses checked before hire and on a schedule. Unlicensed staff are screened against the Texas Employee Misconduct Registry and Nurse Aide Registry before hire.
  • Supervised aides. On-site supervisory visits by a nurse or therapist at least every 14 days for patients receiving skilled care.
  • Documented plans of care. Signed by the physician or allowed practitioner, with measurable goals and timely updates.
  • Rights explained at admission. Every patient receives written rights, our privacy notice and the state complaint hotline.
  • Privacy-safe website. Our forms collect contact details only, and our analytics never receive health information.

Results we measure

We manage our agency to the measures CMS publishes on Care Compare, defined in the Home Health Quality Reporting Program. Results for Medicare-certified agencies are published by CMS on Care Compare, and we point referral partners to that source rather than quoting selectively.

Process

Timely initiation of care

Care begins on the physician-ordered date, or within 2 days of referral or hospital discharge.

Outcome

Discharge Function Score

Patients at or above their expected ability to care for themselves and move around at discharge.

Utilization

Acute care hospitalization

How often patients are admitted to the hospital during the first 60 days of home health.

Utilization

Emergency department use without hospitalization

How often patients need the emergency room during the first 60 days.

Outcome

Discharge to community

Patients who remain home, without unplanned hospital stays, in the 31 days after discharge.

Process

Medication list transferred at discharge

Whether patients and their next provider receive a current, reconciled medication list.

Medicare and Texas Medicaid rules

When care is paid for by a public program, additional rules apply. Our intake team confirms the payer and the authorization path before the first visit. Ask us which Medicaid and managed care plans we currently accept.

  • Texas Medicaid prior authorization. Skilled nursing and home health aide visits are authorized through TMHP or the patient's managed care plan, requested within three business days of the start of care and approved for up to 60 days at a time (TMHP provider manual).
  • Electronic Visit Verification. Required for Medicaid home health visits in Texas since January 1, 2024. Clinicians clock in and out at each visit (Texas HHS EVV).
  • Exclusion screening. Every employee and contractor is checked against the Texas Exclusions List and the federal HHS-OIG LEIE before hire and monthly.
  • Medicare beneficiary notices. Patients receive the CMS notices that apply to them: the ABN before a service Medicare may not pay for, the Home Health Change of Care Notice before services are reduced or stopped, and the Notice of Medicare Non-Coverage with fast appeal rights before covered care ends (CMS Beneficiary Notices Initiative).
  • Accurate billing. We bill only for visits that were ordered, authorized, delivered and documented.
